Small Estate DistributionThe next of kin of a deceased who passed away without a will can always apply to the District land office for a distribution order. This will allow the assets of the deceased (‘the estate’) to be distributed according to the Distribution Act 1958. The application can be done but anyone without the need to engage a lawyer. A recent change in law now allows any estate below the value of RM2million to make such application.
Grant of Probate / Letter of AdministrationHowever, it is certainly advisable to engage a solicitor in the following scenario
- The deceased died without a will, and left behind a complicated estate to administer.
- The deceased died with a will and require the assets to be distributed in a specific manner.
- There are doubts about the validity of the will.
- The deceased had dependents who were deliberately left out of the will, but who might want to make a claim on the estate.
- Assets of the deceased has complex arrangements, such as assets held in a trust.
